Rules of Contest

1. Contest Eligibility and Other Requirements. Each person who enters this contest, by virtue of having entered, consents to the whole of the conditions set out herein. In order to qualify for a chance to win and further in order to actually win the prize you must meet the following qualifications: You must own the property on which the improvement(s) will be installed; You must be at least eighteen (18) years of age, a United States citizen and competent to sign contracts; You, together with any/all joint owners of the property to be improved must sign any/all documents related to the prizewinner(s)’ eligibility, participation and limitations required by Show Producer/Promoter; You must sign any/all waivers to allow your likeness, voice, and project to be publicized by the vendors who are performing work on your property without reservation and without compensation other than the prize awarded; You must not be an owner, officer, director, shareholder, partner, manager, member, employee or related to an owner, officer, director, shareholder, partner, manager, member, employee of any Show Vendor or Show Producer/Promoter. All governmental statutes, laws, rules and regulations applicable govern this contest. In the event that the prizewinner(s) do not meet the eligibility requirements as determined in the sole discretion of the Show Producer/Promoter then the initially designated prizewinner(s) shall be determined to be ineligible and the successor prizewinner(s) shall become the sole prizewinner(s); successor prizewinner(s) will be determined in a random fashion at the sole discretion of the Show Producer/Promoter. Only one entry per person will be accepted. Deadline for entry is: 3:30 p.m. (Indiana Time) on February 28th, 2010. Prizewinner(s) will be announced on: February 28th, 2010 at 4:00 p.m. (Indiana Time).

2. Terms. The prizewinner’s intended Home Makeover project must be within fifty(50) miles of the site of the Fort Wayne Home and Garden Show. The prizewinner(s) can use up to Fifty Thousand Dollars ($50,000.00) in offered Vendors products/services and in the increments offered pursuant to the limitations of value of each set by the Show Producer/Promoter in conjunction with the Vendors; to the extent that the prizewinner(s) do not use the full Fifty Thousand Dollars ($50,000.00) then the unused balance is waived and not usable by the prizewinner(s). The prizewinner(s) are responsible for any/all taxes due on the projects undertaken on the prizewinner(s) property and will cooperate in providing any/all necessary taxpayer information to Show Producer/Promoter in order to be in full tax compliance. The prizewinner(s) will sign Vendor’s normal contracts prior to any Vendor’s project beginning on the prizewinner(s)’ property. Prizewinner(s) is not obligated to purchase any goods or services from Vendor(s) in excess of the amount awarded as part of the prize; however, recognizing that sometimes the scope of work desired may exceed the value of the prize awarded, prizewinner(s) and Vendor(s) are free to contract for additional work if both desire. Entrants, by virtue of their entering the contest, if becoming the prizewinner(s) release the Vendor(s) and Show Producer/Promoter, their parent and all their respective affiliated companies and all other businesses involved in this contest, as well as the employees, officers, directors, shareholders, representatives, agents, successors and assigns of each from all claims, liability, law suits, costs, expenses, fees, injuries (including death), losses, and damages relating to their participation, acceptance and use of any prize. Prizewinner(s) assume all liability for any injury or damage, including death caused or claimed to be caused by participation in this contest or use/redemption of prize(s). Void where prohibited or restricted. Winning a prize is contingent on fulfilling all requirements in these rules. Additionally, the prizewinner(s) hereby relieves Show Producer/Promoter from any/all liability of all sort and description for its hosting of the Fort Wayne Home and Garden Show and arranging for the awarding of the prize discussed herein, including without limitation consequential damages, incidental damages, lost profits. If there is a dispute between the Vendor and the prizewinner(s) it is specifically agreed that the Show Producer/Promoter shall not be part of that dispute (whether in arbitration or lawsuit) and it is further agreed that if prizewinner(s) shall have sought to bring Show Producer/Promoter into any arbitration or lawsuit that Show Producer/Promoter shall immediately be dismissed with prejudice and Show Producer/Promoter’s reasonable attorney’s fees and costs shall be paid by prizewinner(s). If the actual value of a prize is lower than stated herein, the difference will not be awarded in cash. In the event that, for reasons beyond their control and not related to the prizewinner(s), the Show Producer/Promoter is unable to award prize as described in these Official Rules, the Show Producer/Promoter and Vendor(s) will substitute the prize with another prize of similar nature and equal or greater value at their sole discretion.

With the exception of immediate family who by accepting assignment of the prize agree to all terms herein, the prize is non-assignable and non-transferable and not redeemable for cash. If selected prizewinner(s) is/are unable to accept the prize (or assign it in writing to an immediate family member who shall have agreed in writing to all the terms and conditions) in its entirety for any reason, the selected prizewinner(s) will forfeit the prize and the prize will be awarded to an alternate winner. All entries and potential prize winners are subject to verification by Show Producer/Promoter, whose decisions are final and binding. Entry and acceptance of prize constitutes permission (except where prohibited by law) to use winner’s name, prize won, hometown, likeness, photograph, voice, address (city and state) and biographical information in any media throughout the world in perpetuity for purposes of advertising, online posting, promotion and publicity without additional compensation.

3. Procedure. The following procedure shall serve to govern the awarding of the prize to prizewinner(s). First, all persons desiring to be awarded the prize(s) shall comply with the entry requirements set out herein and as may be subsequently set out by the Show Producer/Promoter, from time to time, in its sole discretion. Second, from the pool of eligible entrants, the Show Producer/Promoter shall determine a random method selecting the prizewinner(s) at a time and place of Show Producer/Promoter’s own choosing. Third, within a time determined by the Show Producer/Promoter the prizewinner(s) shall present him/herself for the prize awarding ceremony, signing of appropriate documents and other related events and procedures as may be determined in the sole discretion of the Show Producer/Promoter.

4. Definition of Terms. Show Producer/Promoter is defined as Fort Wayne Shows, Inc., an Indiana corporation. Vendor is defined as any/all contractors who are both exhibitors at the Fort Wayne Home and Garden Show presented by the Show Producer/Promoter and who have been identified as participants in the Fifty Thousand Dollar ($50,000.00) Ultimate Home Makeover Giveaway.? Prizewinner(s) is the person (including joint-owners) of real estate who is/are selected as the winner of the Drawing at which a qualified, eligible and successful winner is selected; such selection shall be in manner and method determined by the Show Producer/Promoter in its sole discretion and determination which Show Producer/Promoter intends generally to reflect a random selection from the pool of registered, eligible participants. Registered Eligible Participants is a pool of those persons who are paid attendees at Show Producer/Promoter’s consumer show in Allen County and who are qualified as that term is used within this document.

5. Duties of Prizewinner(s). In addition to the other duties as may be set out herein, the prizewinner(s) shall have the following obligations as a concomitant responsibility to the privilege of winning the award provided by the Vendor(s) through the good offices of the Show Producer/Promoter: Prizewinner(s) shall allow her/himself and the prizewinner(s)’ project to be photographed/videoed for purposes of Vendor(s)’ and Show Producer/Promoter’s publicity. As a condition of entry into the contest, you must agree to the full terms and conditions set out above.
